Terms of Service

1. Overview

Welcome to Riobamba (the “Company”, “we”, “us”), operating the website https://www.riobambaswim.com/ (the “Site”).
The Site allows customers in the United States and internationally to browse and purchase our swimwear, resortwear and accessories (the “Products”), and to contact us.

By accessing or using the Site, placing an order, or communicating with us through the Site, you agree to these Terms of Service (the “Terms”). If you do not agree, please do not use the Site.

We may update these Terms from time to time. If we make a material change, we will post it on the Site. Your continued use of the Site after changes means you accept the updated Terms.


2. Use of the Site

  • The Site and all content on it are provided “as is” for personal, non-commercial use.
  • You may not copy, distribute, modify, resell, publish, or make derivative works from the Site or its content without our prior written consent.
  • The Site may be accessed from any device and from any country, but availability of products, shipping, and pricing may vary by destination.


3. Eligibility

To purchase from the Site you must:

  1. Be at least 18 years old (or older, if required by your local law); and
  2. Use a valid payment method that you are authorized to use.

We may refuse service, cancel orders, or block accounts in cases of fraud, abuse, non-payment, chargebacks, or violation of these Terms.


4. Prices, Taxes, and Duties

  • Prices on the Site are shown in the currency displayed at checkout (USD or otherwise).
  • For international  customers: prices do not include state/local sales tax unless stated otherwise — tax may be added at checkout where applicable.
  • For international customers ( prices do not include customs duties, import taxes, VAT/GST, brokerage or handling fees charged by your country. These are your responsibility and may be collected at delivery or at checkout (if we offer prepayment).
  • If your country charges duties/taxes on imported swimwear, you will be responsible for paying them. We do not refund these fees if you return the item.


5. Orders and Availability

  • An order placed on the Site is an offer to buy. We will confirm by email once the order is accepted and processed.
  • We reserve the right to refuse or cancel any order, for example if the item is out of stock, if pricing or product information was incorrect, or if payment was not authorized.
  • We do not guarantee availability of all items shown on the Site.

6. Shipping

6.1 

  • We ship to several International locations.
  • Shipping methods, costs and delivery estimates will be shown at checkout.
  • Delivery times are estimates only. Carrier delays may occur (weather, holidays, volume, customs). We are not responsible for delays caused by the carrier.

6.2 International Shipping

  • We offer standard expedited international shipping via Israel Post(or another courier, as available).
  • Processing time: 1–2 business days.
  • Delivery time: typically 10–14 business days after order fulfillment. During holidays/sales, please allow up to 7 additional business days.
  • International shipping cost: $20 USD, and free shipping on orders over $150 USD (unless otherwise stated on the Site).
  • All international shipments may be subject to duties, taxes, and import fees charged by your local customs authority. These are not included in the product price and are non-refundable.
  • If the carrier or customs requests payment of duties/taxes to release the package, it is the customer’s responsibility to pay it.
  • We are not responsible for shipments that are refused, unclaimed, delayed or returned due to unpaid duties/taxes.
  • We are not responsible for shipments lost or not delivered where the carrier shows no successful delivery scan and the customer did not purchase additional insurance.

6.3 Delivery Issues
If the address provided is incorrect, incomplete, or the package is not accepted, any reship or return shipping cost will be charged to the customer.

7. Returns & Exchanges

We want you to love your swimwear.

U.S. & International

  • We accept returns of items in original condition — unused, unworn, unwashed, unaltered, with all tags and the original hygiene liner attached.
  • Return requests must be made within 2 days of delivery, and the item must be returned within 14 business days of receiving your order.
  • Refunds can be issued as store credit or to the original payment method, with a 5% restocking fee deducted (or as stated on the Site).
  • Shipping, taxes, and duties are non-refundable.
  • Return shipping is at the customer’s expense. Please return with a trackable service — we are not responsible for shipments lost or not delivered.
  • Items purchased on sale, markdown, or with a discount code may be final sale and not eligible for a refund — see the specific sale policy on the Site.

International exchanges

  • We do not offer exchanges for international orders. If you need a different size, please return your item (if eligible) and place a new order.

8. Marketing & Communications

By creating an account or making a purchase, you may receive emails about your order (confirmations, invoices, shipping updates) — these are operational and not promotional.
You may also opt in to receive marketing emails. You can unsubscribe at any time via the link in the email.

9. Intellectual Property

All content on the Site — including text, images, photos, product designs, logos, graphics and the name RIOBAMBA / RioBamba Swim — is owned by the Company and protected by copyright, trademark and international IP laws.
You may not copy, reproduce, distribute, modify or use our content for commercial purposes without our prior written consent.

10. Disclaimer & Limitation of Liability

The Site, its content, and the services offered through it are provided “as is” and “as available.”
To the fullest extent permitted by law:

  • We do not guarantee that the Site will be uninterrupted or error-free.
  • We do not guarantee that colors, sizing, or product photos on screen will match the actual product.
  • We are not liable for delays or failures caused by carriers, customs, strikes, force majeure, internet problems, or events beyond our control.

In any event, our total liability to you for any claim arising from your use of the Site or purchase of Products shall not exceed the amount you actually paid for the relevant order.

11. Third-Party Links

The Site may contain links to third-party websites or services. We are not responsible for their content, policies or actions. Your use of such sites is at your own risk.

12. Governing Law & Jurisdiction

Because we sell internationally, but operate as an Israeli brand, these Terms shall be governed by the laws of Israel(unless mandatory consumer protection law of your country requires otherwise).
Any dispute shall be brought before the competent courts in Tel Aviv–Jaffa, Israel, unless otherwise required by applicable consumer law.

If you are a U.S. consumer, you may have rights under your state’s consumer protection laws — these Terms are not intended to limit such mandatory rights.
